David M. DeVito




David M. DeVito is a shareholder at KCR and concentrates his practice on Bankruptcy Litigation and Complex Commercial Litigation matters. Prior to joining KCR, Mr. DeVito was associated with the international law firm Greenberg Traurig, LLP, where he practiced in the Litigation and Business Reorganization and Financial Restructuring groups in the Philadelphia and Washington, D.C. offices of the firm. Before entering private practice, Mr. DeVito served as a law clerk for the Honorable Deborah L. Cook of the United States Court of Appeals for the Sixth Circuit, the Honorable Sara Lioi of the United States District Court for the Northern District of Ohio, and the Honorable Arthur S. Weissbrodt of the United States Bankruptcy Court for the Northern District of California. While in law school, he worked on litigation and investigations as an intern with the Consumer and Environmental Protection Unit of the San Diego City Attorney’s Office, represented low-income residents of San Diego in California Superior Court as a member of the law school Civil Clinic, and contributed to articles on hedge fund activism, credit derivatives and the role of credit rating agencies while serving as a Research Assistant to Professor Frank Partnoy.

  • Lead counsel defending mortgage lender in consolidated state court tort litigation and related federal court insurance coverage action arising out of multi-million dollar Ponzi scheme

  • Representing medical imaging companies in $50 million litigation against lender based upon illegal bankruptcy filing

  • Prosecuted claims on behalf of bankruptcy trustee against sponsors of fraudulent buyout transactions and prepackaged bankruptcy filings that defrauded creditors out of $200 million

  • Represented engineering firm in federal and state court litigation regarding telecom services agreements

  • Represented liquidating trustee in federal court litigation to recover more than $30 million in fraudulent conveyances arising out of real estate-based Ponzi scheme

  • Represented publicly-held insurance company in federal circuit court appeals arising out of administrative law matters

  • Defended national pharmacy chain in False Claims Act case regarding Medicare and Medicaid payments
